What Are Assault & Battery?

Battery is the unwanted touching of another person. This offense can also be charged as a misdemeanor or a felony depending on the severity of the physical harm caused to the victim. For example, if an individual only threatens to harm another person but does not actually carry out that threat, then they can be charged with harassment, which is a violation.

Penalties for Assault & Battery in New York

Assault and battery are both punishable by up to one year in jail. This sentence can be increased if the crime involves the use of a weapon. In addition, an individual convicted of either of these offenses may be forced to pay a fine and be required to participate in counseling or anger management classes.

If the individual has a prior conviction for either assault and/or battery, then they may be charged with a felony. If convicted of a second-degree misdemeanor, then the individual may be forced to pay a $500 fine. If convicted of a first-degree misdemeanor, then the individual may be forced to pay a $1,000 fine. If convicted of a third-degree felony, then the individual may be forced to pay a $5,000 fine. Furthermore, the individual may be sentenced to up to two years in jail.
