Murder Charges in New York


Murder charges in New York include the following:

  • Murder in the first degree
  • Murder in the second degree
  • Aggravated murder

Murder in the first degree is covered under Section 125.27 of the New York Penal Code. It is defined as “intent to cause the death of another person.” This law covers sections concerning intended victims, such as police officers, firefighters, paramedics, judges, prison employees, and witnesses to crimes as well as murder for hire, torture, and murder as a result of terrorist acts. This law also includes murder committed while “under the influence of extreme emotional disturbance” as well as felony murder while committing or fleeing from such crimes as robbery, rape, arson, kidnapping, and more. It is charged as a Class A-1 felony. 

Penalties include 20 to 25 years in prison or life imprisonment. 

Second-degree murder is defined under Section 125.25 of the New York Penal Code while aggravated murder is covered under Section 125.26. These crimes are also charged as Class A-1 felonies. These crimes are generally differentiated from first-degree murder because they involve acting under the influence  of “extreme emotional disturbance.”
